This is to notify you that Your tender dated 17-01-2013 for the execution of the Works for Improvement of Sherpur NHW-Ranirhat GC Road (via Penchulhat & Kuchuapara) (Ch:15150-25367m) UZR, Road ID : 110882009 under Sherpur Upazila, Dstrict-Bogra, Package No-LGED/SRIIP/BGR/W-016 for the Contract Price of Tk. 8,34,20,627.73 (Taka Eight Crore Thirty Four Lac Twenty Thousand Six Hundred Twenty Seven & Paisa Seventy Three) Only, as corrected and modified in accordance with the Instructions to Tenderers, has been approved by the competent authority.
You are thus requested to take following actions :

i. |
Accept in writing the Notification of Award within seven (7) working days of its issuance pursuant to ITT Sub Clause 63.1. |
|
|
ii. |
Furnish a Performance Security in the form as specified and in the amount of Tk. 41,72,000.00 (Taka Forty One Lac Seventy Two Thousand) Only, within Seven (7) working days of acceptance of this Notification of Award but not later than 04-06-2013, in accordance with ITT Clause 65. |
|
|
iii. |
Sign the Contract within Fourteen (14) working days of issuance
of this Notification of Award but not later than |
In addition, according to decision of TEC you are Instructed to follow the
following Clauses :

· |
GCC Clause No. 67-(Payments to Contractor) : According to GCC Clause Reference No. 61-Bill of Quantities you are to be paid for the quantity of the work done at the rate in the Bill of Quantities for each item. But due to front loading for each progressive bill, the rate will be the average rate i.e. 4.93% higher that official rate for each item or the rate quoted for that particular item whichever is less. Final payment will be paid using as your quoted rates. |

· |
GCC Clause No. 90.1-(Payment upon Termination): If your are Terminated because of a fundamental breach of contract under GCC Sub-Clause 89.1 by you, the value of the Works done and the works not completed will be calculated using average rate i.e. 4.93% higher than official rate instead of the rate in the Bill of Quantities. The payment will be made according to the calculation made using the average rate and other punitive measures will be taken as specified in the tender document. |
You
may proceed with the execution of the Works only upon completion of the above
tasks. You may also please note that this Notification of Award shall
constitute the formation of this Contract which shall become binding upon you.
We
attach the draft Contract and all other documents for your perusal and
signature.
