This is to notify you that Your tender dated 06-01-2015 for the execution of the Works for Construction of 75m Long RCC Girder Bridge on Gossaibari GC to Sonahata GC Road at Ch: 7600m, Road ID: 110272008 under Dhunot Upazila, District-Bogra, Package No-LGED/SRIIP/BGR/WS-201 for the Contract Price of Tk. 4,37,52,341.43 (Taka Four Crore Thirty Seven Lac Fifty Two Thousand Three Hundred Forty One & Paisa Forty Three) Only, as corrected and modified in accordance with the Instructions to Tenderers, has been approved by the competent authority.

You are thus requested to take following actions :

i.	Accept in writing the Notification of Award within seven (7) working days of its issuance pursuant to ITT Sub Clause 63.1.
ii.	Furnish a Performance Security in the from as specified and in the amount of Tk. 43,75,235.00 (Taka Forty Three Lac Seventy Five Thousand Two Hundred Thirty Five) Only, within Fourteen (14) days of acceptance of this Notification of Award but not later than in accordance with ITT Clause 65.
iii.	Sign the Contract within Twenty eight (28) days of issuance of this Notification of Award but not later than in accordance with ITT Sub Clause 69.2.

In addition, according to decision of TEC you are Instructed to follow the following Clauses :

·	GCC Clause Reference No.67- Payment to the Contractor: According to GCC Clause Reference No. 61-Bill of Quantities, the Contractor should be paid for the quantity of the work done at the rate in the Bill of Quantities for each item. But due to front loading for each progressive bill, the rate will be average rate quoted by the contractor or the rate quoted for that particular item whichever is less. Final payment will be paid using tenderers quoted rates.
·	GCC Clause Reference No.77- Performance Security. The amount of Performance Security will be 10% (Ten percent) Tk. 43,75,235.00 (Taka Forty Three Lac Seventy Five Thousand Two Hundred Thirty Five) Only of the contract price as written in Tender Date Sheet ITT Clause Reference No.64.1 & 65.1.
·	GCC Clause Reference No.90.1- Payment upon Termination: If the Contract is terminated because of a fundamental breach of contract under GCC Sub Clause 89.1 by the Contractor, the value of the Works done and the works not completed will be calculated using overall average rate quoted by the contractor or the rate quoted for that particular item (BOQ rate) whichever is less. The payment to the contractor will be made according to the calculation made using the above mentioned rate and other punitive measures will be taken as specified in the tender document.

You may proceed with the execution of the Works only upon completion of the above tasks. You may also please note that this Notification of Award shall constitute the formation of this Contract which shall become binding upon you.
